Terms & conditions

These terms explain how to use this website and buy from Kasia Clarke, a sole trader based in Surrey, England. They apply alongside the product description, any terms expressly agreed for your order, and the Shipping & Returns policy. Nothing here removes rights you have as a consumer under applicable law.

Products and descriptions

The website offers original art, books, cards and occasional prints, and links to online courses and digital guides. Each listing sets out what you are buying, the price and relevant specifications. Framing, delivery format and included items are as described in the listing and your order.

Photographs are prepared to represent the work faithfully, but screens can display colours differently. Room photographs may illustrate how a work could look; use the listed dimensions to judge its size. These explanations do not limit your cancellation rights or your rights if goods are not as described.

Ordering and payment

Review the description, quantities, delivery address, shipping format and total before submitting your order. Checkout shows the payment methods, currency, delivery charges and taxes collected at checkout. Import charges not collected at checkout are explained in Shipping & Returns. Bank transfer can be arranged directly by email.

An automated order acknowledgement confirms receipt of your order. For physical goods, acceptance takes place when I send a dispatch confirmation or expressly confirm acceptance for an agreed commission or collection. If I cannot accept an order, including because a unique work is no longer available, I will tell you and promptly refund any payment. If a price or description contains an obvious error, I will contact you before acceptance so you can choose whether to proceed with the correction or cancel.

We communicate about orders in English unless we agree otherwise. You can save or print these terms for your records. The terms agreed when your order is accepted govern that order; later website updates will not retrospectively change them.

Delivery, cancellations and problems

Read Shipping & Returns for costs, timing, rolled-canvas arrangements, cancellation instructions and refund rules. If a problem arises, please contact me with your order details so I can investigate and propose a remedy. You retain all applicable legal rights.

Commissions

Before a commission starts, we will agree the scope, dimensions, materials, price, payment stages, expected timing and delivery in writing. We will also explain any applicable cancellation arrangements. Genuinely bespoke or personalised goods may be exempt from the usual change-of-mind cancellation right, but must still meet the agreed description and applicable quality requirements. These terms do not make every deposit automatically non-refundable.

Courses and digital guides

Courses and digital guides are supplied through my Teachable school. Check the course description and checkout for the content, price, tax, access period, technical requirements and any additional guarantee. The seller and payment arrangements shown at the relevant checkout apply to that purchase; Teachable’s platform terms also govern use of its service.

You need suitable internet access and a device capable of using the course platform. For help with access, visit Course help & troubleshooting. UK digital cancellation rights and the conditions for immediate supply are explained in Shipping & Returns. A platform policy or course guarantee cannot reduce mandatory consumer rights.

Course materials and guides are licensed to the purchaser for their own learning. Do not share account access, redistribute files, record and resell lessons, or reproduce the teaching materials without permission. This does not prevent you from applying techniques you learn to your own original artwork.

Copyright and website use

Copyright in my artwork, photographs and teaching materials remains with me or the relevant rights holder. Buying a physical work does not transfer reproduction rights. Please ask for written permission before reproducing artwork or using website content commercially, except where the law permits the use.

Use the website lawfully. Do not interfere with its operation, introduce harmful code, misuse another person’s information or attempt unauthorised access. External sites have their own terms. If I use an affiliate link that can earn me a commission, it will be identified as such.

Responsibility and applicable law

I remain responsible for losses you suffer that are a foreseeable result of my breach of contract or failure to use reasonable care and skill, as required by law. Nothing excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot legally be excluded. There is no guarantee that every website feature will be continuously available; this does not remove my obligations for purchases already made.

These terms are governed by the law of England and Wales, subject to any mandatory consumer protections that apply in your country of residence. They do not prevent you bringing proceedings in a court available to you under applicable consumer law.

How personal information is used is explained separately in the Privacy notice. Browsing this website is not treated as consent to every use of your data.
